Lowe Fabrications – Terms and Conditions

1. Overview

Lowe Fabrication is an Australian-owned business specialising in custom automotive fabrication, performance parts, and vehicle components.

By accessing, using, or placing an order through our website or directly with Lowe Fabrication, you agree to the following Terms and Conditions.

These terms are intended to operate alongside all rights and protections afforded under Australian Consumer Law.


2. Pricing, Quotes and Website Accuracy

All prices are listed in Australian Dollars (AUD) and include GST where applicable unless otherwise stated.

Prices, specifications, availability, freight charges, and product information are subject to change without notice.

While Lowe Fabrication makes every effort to ensure pricing, product descriptions, specifications, images, and availability are accurate, errors may occasionally occur.

Lowe Fabrication reserves the right to correct any errors, inaccuracies, or omissions at any time without prior notice, including after an order has been submitted.

Where a product or service is listed at an incorrect price or with incorrect information due to typographical error, supplier pricing changes, technical issue, currency fluctuation, freight adjustment, or system error, Lowe Fabrication reserves the right to cancel, refuse, or amend the order.

If payment has already been made for an affected order, Lowe Fabrication may provide the customer with the option of:

  • proceeding with the corrected pricing or information
  • receiving a store credit
  • receiving a full refund

Quotations are valid for 7 days unless otherwise stated.

Material surcharges may apply where significant increases in steel, freight, coating, imported component, or supplier costs occur after quotation.


3. Product Availability and Lead Times

Many Lowe Fabrication products are manufactured, assembled, coated, modified, or sourced to order.

Estimated lead times are provided as a guide only and may vary due to supplier availability, workshop scheduling, coating processes, freight delays, material supply, or operational demand.

Lowe Fabrication will make reasonable efforts to communicate significant delays where possible.


4. Product Use and Installation

All products sold by Lowe Fabrication are intended for off-road, motorsport, performance, racing, show, or modified vehicle use unless otherwise stated.

It is the customer’s responsibility to ensure correct fitment, compatibility, installation, engineering approval, and suitability for their intended application.

Improper installation, misuse, abuse, modification, or incorrect application may void warranty and compromise vehicle safety.

Lowe Fabrication strongly recommends installation by qualified automotive professionals.

Motorsport and modified vehicle components are subjected to significantly higher stresses than OEM applications. The purchaser accepts responsibility for ensuring the suitability of any product for their intended application and vehicle use.


5. Shipping and Delivery

Orders are shipped via Lowe Fabrication’s selected freight and courier providers.

Tracking details will generally be provided once goods have been dispatched.

Delivery times are estimates only and may vary depending on stock availability, production scheduling, destination, and courier performance.

International customers are responsible for all customs duties, taxes, import charges, and local compliance requirements unless otherwise agreed in writing.

Risk associated with goods passes to the purchaser upon dispatch or collection.


6. Freight Damage and Delivery Issues

Customers should inspect goods upon delivery and notify Lowe Fabrication of any freight damage, shortages, or delivery issues within 48 hours of receipt where possible.

Freight and damage claims may require photographs, supporting documentation, and original packaging for assessment.

Lowe Fabrication is not responsible for delays, damage, or losses caused by third-party freight providers beyond obligations required under Australian Consumer Law.


7. Pickup Policy

Customer pickup is available strictly by prior arrangement only.

All pickups must be confirmed in advance with our team to ensure product availability, staffing, and site access.

Customers should not attend the workshop or dispatch premises without prior confirmation.


8. Returns, Exchanges and Order Cancellations

Returns and exchanges must be approved by Lowe Fabrication prior to goods being returned.

Change-of-mind returns may be accepted within 14 days of delivery at Lowe Fabrication’s discretion and may incur a 15% restocking and handling fee.

Approved returned items must:

  • be unused and uninstalled
  • be in original packaging and saleable condition
  • include proof of purchase

Freight costs associated with returns are the responsibility of the customer unless otherwise required under Australian Consumer Law.

Custom-made, fabricated, coated, modified, electrical, made-to-order, or special-order items are generally non-refundable unless faulty or otherwise required under Australian Consumer Law.

Orders cancelled after production, coating, machining, fabrication, sourcing, or processing has commenced may incur administration, labour, material, coating, or restocking charges.

Nothing in these terms excludes the rights and remedies afforded under Australian Consumer Law.


9. Warranty

Warranty coverage varies depending on product type, intended application, and operating conditions unless otherwise stated.

Most products supplied by Lowe Fabrication carry a 12-month manufacturer warranty against defects in materials or workmanship under normal intended use.

Custom, fabricated, prototype, motorsport, or modified-use products are covered under Lowe Fabrication’s fair-use and common-sense warranty approach.

Warranty does not cover:

  • incorrect installation
  • misuse or abuse
  • accident or impact damage
  • corrosion or environmental exposure
  • normal wear and tear
  • competition damage
  • unauthorised modification
  • incorrect fitment or application

Lowe Fabrication does not cover labour costs, workshop charges, towing, freight, accommodation, transport costs, vehicle downtime, or associated third-party expenses unless expressly agreed in writing.

Lowe Fabrication complies with Australian Consumer Law and honours all rights afforded to consumers.


10. Liability

Lowe Fabrication is not liable for any loss, damage, injury, or consequential expense resulting from misuse, incorrect installation, unauthorised modifications, or use outside intended operating conditions.

Under no circumstances shall Lowe Fabrication be liable for indirect, incidental, special, or consequential damages including loss of profits, loss of vehicle use, workshop downtime, or commercial losses except where liability cannot legally be excluded under Australian law.


11. Title of Goods

Ownership of goods remains with Lowe Fabrication until payment has been received in full and cleared funds confirmed.


12. Intellectual Property

All website content, product images, CAD files, product designs, descriptions, logos, branding, part numbers, drawings, technical information, and associated intellectual property remain the property of Lowe Fabrication unless otherwise agreed in writing.

These materials may not be copied, reproduced, distributed, modified, or used commercially without prior written permission.

Lowe Fabrication reserves the right to refuse supply, limit quantities, or restrict resale activity at its discretion.


13. Privacy

Personal information provided to Lowe Fabrication is handled in accordance with our Privacy Policy, which outlines how customer information is collected, stored, and used.


14. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

By purchasing from or dealing with Lowe Fabrication, you agree to submit to the jurisdiction of the courts of New South Wales.


15. Changes to Terms

Lowe Fabrication reserves the right to update or modify these Terms and Conditions at any time without prior notice.

Continued use of the website, services, or purchase of products constitutes acceptance of the updated Terms and Conditions.
